Clean Break Order - Financial Consent Order - Contested Financial Remedy
Whilst many just require a straightforward divorce, it is very common that there are joint assets to a marriage such as the marital home, bank accounts or other high value possessions.
We work with clients who are looking to petition for divorce, or who are already in the divorce process, who either wish to sever the Financial Ties which exist within a marriage or who need to resolve matters relating to the Marital Finances and jointly owned assets.

Clean Break Order
It is a common misconception to think that the Final Order of Divorce means that all ties to the marriage have ended. Whilst the Final Order of Divorce ends the Legal Ties of the marriage, it does not end the Financial Ties which are created when people marry.
Even when there are no assets to a marriage, financial ties still exist between spouses even after divorce unless provision is put in place to sever those ties. This is done via a Clean Break Order. Without a Clean Break Order being made you may be subject to future financial claims from an ex-spouse and this is particularly important to consider if your financial position may change in the future.
We work with clients to put Court Clean Break Orders in place either as part of on-going divorce proceedings or after the Final Order of divorce has been granted.

Financial Consent Order
A Financial Consent Order is a Court Order which details how the marital finances shall be resolved. As its name suggests, this is an agreement reached between parties without the Court being asked to adjudicate on the matter. We work with clients who have either already reached agreement with their spouse or who need assistance in negotiating the finer detail.
A Financial Consent Order will typically deal with lump sum payments where one party is buying the equitable interest of the other in significant assets such as the marital Home. They can also deal with the distribution of funds where it is agreed that an asset should be sold.

Contentious Financial Remedy
Where matters cannot be resoled amicably then formal proceedings before the Court can be required.
We work with our clients to carefully support their position within any formal proceedings and our focus on strategy and thorough preparation ensures that they are best equipped to progress through the proceedings feeling confident and empowered.
We assist in the preparation of all Court Documents including applications and statements. We also work closely with a network of Barristers and we can direct you to the most appropriate advocate to represent your case at Court. Our work includes liaising with any appointed Counsel so that they fully understand your case and we always ensure that they remain fully briefed throughout.
Even when contentious proceedings are underway, we still work tirelessly to seek early resolution and our strategic approach to case management often sees issues resolved in advance of the contested process being fully completed.
Our fee structure for Contentious Financial Matters is unique and designed to ensure that our clients save considerable amounts of money whilst remaining fully in control of their ongoing costs. We manage Contentious Financial Matters on a Monthly Retained Basis with the Costs being Capped. This allows clients to benefit from a manageable monthly payment whilst also knowing what their maximum outlay will be. This approach sees our clients save £1,000's of pounds on the cost of contentious financial proceedings.
